Terms of Service

Welcome to Marg. These Terms of Service (“Terms”) govern your access to and use of the Marg platform (“Platform”, “Service”), operated by Pascalblue Studio Pvt Ltd(“Company”, “we”, “us”, “our”), a company incorporated under the laws of India. By accessing or using Marg, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

How we process personal data is described separately in our Privacy Policy (our notice under the Digital Personal Data Protection Act, 2023). Agreeing to these Terms does not by itself constitute consent to process personal data under the DPDP Act; consent, where required, is obtained as described in the Privacy Policy.

1. Use of the Service

Marg is a community-driven field guide for navigating complex public buildings (hospitals, government offices, courts, etc.). The information provided is for general navigational purposes only and does not constitute official, legal, medical, or professional advice of any kind.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not use the Service in any way that could damage, disable, overburden, or impair the Platform.

2. Account Registration & Security

To access certain features (including contributing, earning points, and redeeming rewards), you must create an account. You agree to:

• Provide accurate, current, and complete information during registration;
• Maintain only one account — multi-accounting is prohibited;
• Keep your login credentials confidential and notify us immediately of any unauthorised use;
• Be at least 18 years of age. The Service is not directed to children. Processing of a child's personal data requires verifiable parental/guardian consent under the DPDP Act, which Marg does not offer as a consumer product path.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Contributions

By submitting information, tips, flow guides, wait-time updates, or other content (“Contributions”) to Marg, you:

• Grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that content in any media;
• Represent and warrant that each Contribution is your original work, does not infringe any third-party intellectual property or privacy rights, and does not contain unlawful, defamatory, or objectionable content;
• Agree not to submit false, malicious, misleading, or inappropriate content;
• Acknowledge that Contributions are publicly visible and should not contain sensitive or personally identifiable information.

4. Prohibited Conduct

You agree not to:

• Impersonate any person or entity, or falsely claim an affiliation;
• Upload or transmit viruses, malware, or any harmful code;
• Scrape, crawl, or use automated systems to access the Platform without express permission;
• Interfere with or disrupt the Service, servers, or networks;
• Engage in any form of vote manipulation, spam, or abuse of the gamification system;
• Circumvent or attempt to circumvent security measures, fraud detection, or eligibility gates;
• Use the Service for any commercial purpose without our prior written consent;
• Violate any applicable local, state, national, or international law or regulation.

5. Rewards & Points Programme

The Marg Rewards & Points Programme is governed by separate Rewards Programme Terms, which are incorporated into and form part of these Terms. By participating in the Rewards Programme, you agree to those additional terms.

6. Intellectual Property

The Platform and its original content (excluding user Contributions), features, and functionality are and shall remain the exclusive property of Pascalblue Studio Pvt Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of India and international treaties.

“Marg”, the Marg logo, and “Pascalblue Studio” are trademarks of Pascalblue Studio Pvt Ltd. You may not use these marks without our prior written consent.

7. Third-Party Services & Links

The Platform may contain links to third-party websites, services, or content that are not owned or controlled by us (including payment providers, map services, and authentication providers). We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. Use of third-party services is at your own risk and subject to their respective terms.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive for accuracy, we make no guarantees regarding the completeness, accuracy, reliability, timeliness, or suitability of the information on the Platform. Building layouts, department locations, wait times, and procedural flows change frequently. Always verify critical information with official sources, on-site staff, and signage.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• Pascalblue Studio Pvt Ltd, its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to use) the Service.
• Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) ₹1,000 (INR) or (b) the total amount you have been paid through the Rewards Programme in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your Contributions; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including, without limitation, ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

12. Personal Data (DPDP Act)

Processing of your personal data is governed by our Privacy Policy, which is the standalone privacy notice for Marg under the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025. Data Principal rights, consent withdrawal, grievance redressal, and retention are described there — not in these Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Before initiating any legal proceedings, you agree to attempt to resolve the dispute informally by contacting us. If the dispute is not resolved within 30 days, either party may proceed with formal legal remedies. Nothing in this section limits your statutory rights to approach the Data Protection Board of India for grievances relating to personal data under the DPDP Act.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through in-app notification, email, or an update to this page. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Rewards Programme Terms, constitute the entire agreement between you and Pascalblue Studio Pvt Ltd regarding the Service and supersede all prior agreements and understandings. The Privacy Policy remains a separate notice for DPDP purposes and is not merged into these Terms.
